1. Introduction
These Terms of Service (“Terms”) govern your access to and use of waitle.io and all related features, tools, websites, and services (collectively, the “Service”).
The Service is owned and operated by Monofact, LLC, a limited liability company organized under the laws of the State of Wyoming, USA (“Monofact”, “we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.
Waitle is currently offered in Public Beta, and features, performance, or availability may change without prior notice.

2. Definitions
“Service” / “Waitle”
The platform, website, dashboard, and infrastructure available at waitle.io and app.waitle.io, including tools for creating and publishing coming soon and waitlist pages.
“User” / “Account Owner”
An individual or entity who creates an account to build and manage pages using the Service.
“User Page” / “Project Page”
A public coming soon or waitlist page created using Waitle, published under a Waitle-hosted URL (e.g., waitle.io/{slug}) or, when supported, a User’s own custom domain or subdomain.
“Subscriber”
A person who submits their email address through a User Page’s form.
“Visitor”
Any individual who visits waitle.io, app.waitle.io, or any User Page without creating an account.
“Content”
Any text, images, branding elements, links, or other materials submitted or uploaded by a User.
3. Scope of Service
Waitle provides a lightweight platform for creating and publishing coming soon and waitlist pages. Using the Service, Users can:
- Build and customize public landing pages
- Add branding, hero text, offers, social media links, and SEO metadata
- Collect and store Subscriber email addresses
- Export Subscriber data in CSV format
- Publish pages under a Waitle-hosted URL (e.g., waitle.io/{slug})
- (When available) connect their own domain or subdomain
- Use ready-made templates and color themes
During Public Beta, additional features—such as analytics, custom domains, integrations, and expanded templates—may be introduced gradually.
Waitle is not an email marketing or mass-email delivery service.
We only store Subscriber email addresses on behalf of Users.
Users are solely responsible for how they communicate with their Subscribers after exporting or using this data.
Waitle does not guarantee uptime, data continuity, email deliverability, domain configuration success, or uninterrupted access to any part of the Service.
4. User Responsibilities
4.1 Accuracy and Ownership of Content
You are solely responsible for all Content you submit, upload, or publish through the Service, including branding, text, images, and external links.
You represent that you own or have legal rights to use such Content and that it does not violate any third-party rights.
4.2 Use of Subscriber Data
If your User Page collects email addresses, you acknowledge and agree that:
- You are the data controller of Subscriber data.
- You are solely responsible for how you store, use, or communicate with Subscribers.
- You must comply with email, privacy, and data protection laws (GDPR, CAN-SPAM, etc.).
- Waitle does not monitor or review your communications with Subscribers.
4.3 Account Security
You are responsible for maintaining the confidentiality of your account and password, and for all activities performed under your account.
4.4 Custom Domains (When Available)
If you connect your own domain/subdomain:
- You are responsible for DNS configuration and propagation.
- Waitle is not responsible for domain errors, SSL issues, or downtime caused by DNS changes.
4.5 Compliance with Laws
You must use the Service in accordance with all applicable laws and regulations.
Waitle is not responsible for violations arising from your use of the Service.
5. Prohibited Uses
You agree not to use the Service for any of the following:
5.1 Illegal or Harmful Activities
Including but not limited to:
- illegal activities
- fraud, impersonation, phishing
- malware distribution
- violence, hate speech, harassment
- copyright or trademark infringement
5.2 Spam, Abuse, or Disruptive Behavior
Including:
- sending unsolicited bulk email
- misleading Subscriber collection practices
- bypassing technical limits
- interfering with the Service or its security
- automated abusive behavior
5.3 Harmful or Sensitive Activities
Including:
- adult content
- gambling or casino content
- selling illegal goods
- encouraging harmful behavior
5.4 Political Content (Allowed With Restrictions)
Political content is allowed, provided it does not:
- violate election laws
- involve harmful or deceptive practices
- solicit political donations unlawfully
5.5 Platform or Network Abuse
You may not reverse-engineer, scrape, harvest data, overload systems, or disrupt the Service.
5.6 Enforcement Rights
Waitle may:
- unpublish pages
- suspend accounts
- terminate accounts
- immediately block access in cases of security or legal risk
- remove harmful or illegal content
Actions may be taken with or without notice.
6. Account Suspension and Termination
We may suspend or terminate your account if:
- you violate these Terms,
- you misuse Subscriber data,
- your Project Page causes legal or security risks,
- you engage in abusive behavior or fraud,
- required by law.
In urgent cases, we may suspend access immediately without notice.
You may close your account at any time.
Upon termination, access to User Pages and Subscriber data may be disabled.
We are not liable for losses arising from suspension or termination.
7. Third-Party Services
The Service integrates with or depends on Third-Party Services, including:
- Resend – email delivery
- Self-hosted, privacy-friendly analytics – We use a cookie-less, anonymous analytics solution hosted on our own infrastructure. It does not collect personal data, track individuals, or use third-party advertising or marketing cookies.
- Cloudflare – CDN, security, DDoS protection
- OAuth providers – login authentication
- (Future) Stripe – payments
We do not control third-party providers and are not responsible for outages, errors, or data issues caused by them.
Use of these services may require compliance with their terms and policies.
8. Intellectual Property
Monofact, LLC retains ownership of:
- the Waitle platform,
- code, software, and infrastructure,
- UI/UX design, branding, and documentation.
Users retain rights to their own Content.
By using the Service, you grant Waitle a limited license to host and process your Content to provide the Service.
9. Warranty Disclaimer
The Service is provided “as is” and “as available”, without any warranties—express or implied.
We do not guarantee:
- uninterrupted service
- error-free functionality
- reliability of storage or data transmission
- compatibility with all devices or browsers
- perfect email or data delivery
You use the Service at your own risk.
10. Limitation of Liability
To the fullest extent permitted by law, Monofact, LLC shall not be liable for:
- indirect or consequential damages
- loss of profits, revenue, business, or data
- downtime, configuration issues, or service interruptions
- actions of Users or Subscribers
If liability is found, the maximum amount payable shall be:
- the fees paid in the last 3 months, or
- USD $0 if you used the Service during Public Beta or without charge.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Wyoming, USA.
All disputes shall be resolved exclusively in the state or federal courts located in Wyoming.
You consent to this jurisdiction and venue.
12. Changes to Terms
We may update these Terms periodically.
Significant changes may be communicated via email or within the Service.
Continued use of the Service constitutes acceptance of updated Terms.
